Terms & Conditions

1. Acceptance of Terms

By booking or attending any class, you agree to be bound by these Terms and Conditions.

If you do not agree, you must not use our services.

We may update these Terms at any time. Updated Terms will apply from the time they are published on our website.


2. Definitions & Structure

  • “Hi Pilates”, “we”, “us” and “our” refers to the Hi Pilates brand and the entity operating the specific studio at which you attend classes (the “Operating Entity”).
  • Each studio may be owned and operated by a different legal entity.
  • When you make a booking or attend a class, you are entering into an agreement with the Operating Entity for that location.

Product Definitions

  • Unlimited Products = any product allowing unlimited attendance
  • Limited Products = fixed number of classes

We reserve the right to classify any product at our sole discretion.


3. Independent Operation & Liability Separation

Each Operating Entity is solely responsible for:

  • its studio operations
  • its staff and instructors
  • the services it provides

To the maximum extent permitted by law:

No other Hi Pilates entity is liable for another studio’s actions.


4. Medical & Fitness Responsibility

You must ensure you are medically fit to participate.

You must inform instructors of:

  • injuries
  • medical conditions
  • pregnancy

Participation is at your own risk.


5. Bookings

Bookings must be made via approved platforms (website or app).

Spots are limited and not guaranteed without booking.


6. Cancellation Policy

  • Group classes: 8-hour cancellation window
  • Private sessions: 24-hour window

Late Cancellation / No Show

  • Limited Products: class forfeited
  • Unlimited Products:
    • Late cancellation: $10
    • No-show: $20

You acknowledge and agree that these fees represent a genuine pre-estimate of loss (liquidated damages) including but not limited to loss of class capacity, instructor costs, and administrative expenses, and are not a penalty.

These policies form part of these Terms and may be updated from time to time.


7. Waitlist

If a class is fully booked, you may join the waitlist.

  • More than 8 hours: may be automatically added
  • Within 8 hours: may be notified and added

Once you are added from the waitlist, this constitutes a confirmed booking and all cancellation policies apply.

You acknowledge that it is your responsibility to monitor your booking and waitlist status at all times.

The waitlist closes 15 minutes prior to class.


8. Memberships & Packs

All classes must be prepaid.

Each product is subject to:

  • a validity period
  • usage conditions
  • applicable rules

as specified at the time of purchase.


Expiry

All class packs have a strict expiry date.

All classes must be used within the stated validity period.

Unused classes will be forfeited.

No extensions, credits or compensation will be provided on the basis that you did not receive an expiry reminder or notification.


No Refund Policy

All purchases are final and non-refundable, except where required by law.


9. Minimum Commitment & Early Termination

Certain memberships are subject to a minimum commitment period, as stated at the time of purchase.

You agree to complete the minimum term.

If cancelled early:

👉 an early termination fee may apply, as disclosed at purchase.


10. Membership Cancellation

All membership cancellation requests must be submitted in writing via email to the relevant studio’s designated email address.

Verbal requests, social media messages, app deletion, or failure to attend classes do not constitute a valid cancellation.

A cancellation will only be effective once a confirmation receipt has been issued by the relevant studio.

It is your responsibility to ensure that your cancellation request has been received and acknowledged.

A minimum of 7 days’ notice is required.


11. Administration Fee

Requests for exceptions (including illness, injury, pregnancy or personal circumstances) may be considered at our sole discretion.

Where granted:

👉 an administration fee of $100 may apply

Such arrangements:

  • are not guaranteed
  • are provided as a goodwill gesture only

12. Minimum Attendance

  • Group classes: minimum 3
  • Small group: minimum 2

Classes may be cancelled if minimum numbers are not met.

A credit or rebooking will be provided.


13. Class Changes

Schedules, instructors and classes may change.

Where a class is cancelled:

👉 a credit or rebooking will be offered

We are not liable for indirect or consequential loss.


14. Conditions of Entry

We may refuse entry or remove any person.

Late arrivals may not be admitted.


Safety & Hygiene

Clients must:

  • wear appropriate attire
  • wear grip (non-slip) socks at all times
  • clean equipment after use

Failure to comply may result in refusal of entry.

No refund, credit or transfer will be provided in such cases.


15. Personal Safety & Risk

Exercise involves inherent risks.

You participate at your own risk.

To the extent permitted by law, liability for injury is limited in connection with recreational services.


16. Pregnancy

You must inform your instructor if pregnant.

Participation is at your own risk.


17. Payments

You must ensure sufficient funds.

If payment fails:

  • fees may apply
  • we may retry charges

18. Misuse

We may suspend or terminate access for misuse or breach.


19. Security

We are not responsible for personal belongings.


20. Promotions

Promotions are subject to separate terms.


21. Privacy

Your data is handled per our Privacy Policy.


22. Limitation of Liability

To the maximum extent permitted by law, we exclude liability for indirect or consequential loss.


23. Governing Law

These Terms are governed by the laws of New South Wales.
